Privacy Policy

Accessibility & Privacy by Design

Subtitle It is developed with two principal commitments: accessibility and privacy. The application is built to minimise data handling, favour local processing, and provide clear, transparent control over any information you choose to process through it.

1. Introduction

This Privacy Policy explains how Subtitle It (“the App”, “we”, “our”, “us”) manages information. Subtitle It is developed in Australia and used internationally. This document is intended to meet global privacy expectations with a focus on strong user protection.

Nothing in this policy constitutes legal advice. You are responsible for ensuring compliance with all laws applicable to your use of the App.

2. Information Handling Approach

Subtitle It follows a local-first architecture. By default, all audio transcription and processing occur on your device. The App does not transmit, store, collect, or receive any personal information unless you expressly enable optional cloud transcription services.

3. Information Processed on Your Device

When using the application in the default "Local" mode:

  • Audio Data: Processed exclusively through Apple’s on-device frameworks.
  • Transcriptions: Saved only within your device’s secure app sandbox.
  • Settings: Stored locally using iOS UserDefaults.
  • No Analytics: The App performs no tracking, telemetry, profiling, or remote logging.

4. Optional Cloud Transcription

If you choose to enable cloud transcription using providers such as OpenAI or AssemblyAI:

  • Your recorded audio will be sent directly to your chosen provider using your API key.
  • API keys are stored only on your device in the encrypted iOS Keychain.
  • Data processed through these providers is subject to their terms and privacy policies.
Important: Use caution when transcribing confidential, sensitive, or regulated information through any cloud provider. Although we provide access to these providers, we do not endorse, affiliate with, control, or influence third‑party data retention or processing practices.

5. Data Retention & Storage

Certain default functionality within the app will clear transcripts. It is the user's responsibility to understand when data will be cleared as part of normal use of the app.

  • All transcriptions remain on your device until deleted by you.
  • If iCloud backup is enabled, Apple may store encrypted backups according to your system settings.
  • We cannot access your recordings, transcriptions, or settings at any time.

6. Data Sharing

Subtitle It does not share, sell, transfer, or disclose any user data. The only data transmitted externally is data you explicitly choose to send to a third‑party transcription service.

7. User Rights

  • Access all stored transcriptions directly within the App.
  • Export or delete data at any time.
  • Disable cloud transcription at any time.
  • Control whether the App stores any information beyond temporary processing.

8. Security

  • API keys stored using iOS Keychain with system-level encryption.
  • TLS/HTTPS encryption is used for all optional cloud communication.

9. Changes to This Policy

This policy may be updated. Revisions will be posted on our website.

Terms of Service

10. Acceptance of Terms

By installing or using Subtitle It, you agree to this Agreement. If you do not agree, you must discontinue use and delete the App.

11. License

You are granted a limited, non‑exclusive, non‑transferable, revocable licence to use the App for lawful purposes. All rights not expressly granted remain with the developer.

12. User Responsibilities

  • You are responsible for complying with applicable privacy and recording laws.
  • You must obtain consent where legally required before recording others.
  • You must not use the App for surveillance, harassment, or illegal purposes.
  • You are solely responsible for the content you record, store, or share.
Recording Law Notice: Recording laws differ by jurisdiction. You are responsible for ensuring that all recordings comply with applicable legal obligations, including consent requirements.

13. Cloud Services

  • You are responsible for your API keys and any associated service charges.
  • We make no guarantees regarding availability, accuracy, or performance of third‑party services.
  • Third‑party terms apply when you use those services.

14. Disclaimer of Warranties

Speech recognition may produce errors or incomplete results. To the maximum extent permitted by applicable law, Subtitle It is provided on an "as‑is" and "as available" basis without warranties of any kind, either express or implied.

We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the App will be uninterrupted, error‑free, secure, or free of viruses or other harmful components.

The App is not designed, intended, or suitable for use in legal proceedings, medical diagnosis or treatment, emergency services, safety‑critical applications, or any situation where errors could lead to death, personal injury, or significant property or environmental damage.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Subtitle It and its developer shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, revenue, profits, business, or opportunities
  • Any legal consequences arising from your recording or transcription activities
  • Actions, omissions, or data practices of third‑party service providers
  • Any errors, inaccuracies, or omissions in transcriptions

To the extent permitted by law, our total aggregate liability arising from or related to your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

Australian Consumer Law: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and obtain a refund for any unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time. Nothing in these terms limits or excludes any guarantees, warranties, representations, or conditions implied or imposed by law that cannot lawfully be limited or excluded.

16. Indemnification

You agree to indemnify, defend, and hold harmless Subtitle It, its developer, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another person or entity, including privacy rights
  • Any recordings you make, store, or share using the App
  • Your failure to obtain required consents for recording

17. International Use

Users outside Australia are responsible for compliance with local laws and regulatory requirements.

18. Governing Law & Jurisdiction

This Agreement is governed exclusively by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.

19. Termination

You may cease using the App at any time by uninstalling it. We may suspend or terminate your access if you violate this Agreement. Termination does not affect any rights or obligations that accrued prior to termination, and Sections 14, 15, 16, 18, and this Section 19 shall survive termination.

20. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from this Agreement. The remaining provisions shall continue in full force and effect.

21. Entire Agreement

This Agreement constitutes the entire agreement between you and Subtitle It regarding your use of the App and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding such subject matter. No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision.
